This is a courtesy translation. The original and legally binding version of these Terms of Use is in Portuguese and is available at termos.html. In case of any discrepancy between this translation and the Portuguese version, the Portuguese version shall prevail.
1. Acceptance of Terms
By accessing and using the Sophyworks.ai platform ("SophyWorks.ai", "SophyWorks", "sophyworks.com", "sophy.works", "we", "our" or "the company"), you agree to comply with and be bound by these Terms of Use. If you do not agree with any part of these terms, you should not use our services.
2. Service Description
Sophyworks.ai is an AI-Powered Product & Problems Management platform designed to assist innovators, product managers, and tactical managers in making strategic decisions, as well as anyone who wishes to innovate with maturity. Our services include content, tools, and features for demand management, innovation management, and product development.
3. Client Responsibility
SophyWorks maintains weekly backups of platform data as part of our data protection and service continuity policy. While we strive to ensure data integrity and availability, we recommend that clients also maintain local copies of their most important data as a best security practice.
In the event of data loss due to circumstances beyond our control (force majeure, exceptional cyber attacks, etc.), SophyWorks commits to restoring data from the most recent available weekly backup.
4. Service Discontinuation
The SophyWorks platform may be discontinued at any time due to:
- Force majeure or unforeseen events
- Technical or operational incapacity
- Operational issues
- Scenarios where the cost-to-benefit ratio prevents operation
In the event of discontinuation, there shall be no liability for the platform's authors. For purchases made within the last 30 days, a full refund will be offered.
5. Intellectual Property
All content, methodology, algorithms, and intellectual property related to Sophyworks, the BORA model, the book "Product Innovation Ops", and the platform are the exclusive property of the authors. Use of the platform does not confer intellectual property rights over the solution or methodology.
You agree not to copy, distribute, modify, or create derivative works based on our intellectual property without express authorization.
6. Acceptable Use
You agree to use the platform only for lawful purposes and in accordance with these terms. The following are prohibited:
- Using the platform for illegal activities
- Attempting to access unauthorized systems or data
- Interfering with the platform's operation
- Sharing access credentials
- Using the platform for spam or malicious content
7. Limitation of Liability
Under no circumstances shall SophyWorks be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or use, arising from the use of or inability to use the platform.
8. Payments and Refunds
Payments are processed according to the selected plans. Refunds are offered only within the first 30 days of purchase, as per the discontinuation policy described in section 4.
9. Modifications to Terms
We reserve the right to modify these terms at any time. Changes will take effect immediately upon publication. Continued use of the platform after modifications constitutes acceptance of the new terms.
10. Governing Law
These terms are governed by Brazilian law. Any dispute shall be resolved in the competent courts of Brasília, DF, Brazil.
